These terms govern use of the wholesale ordering system provided by M&J Bakery Inc (also trading as Manhattan Bakery NC), P.O. Box 149, Morrisville, NC 27560 ("we", "us"). By signing in and placing an order you accept them.

Who may use it

Access is limited to businesses holding an account with M&J Bakery and to our own staff. Accounts are created by us; there is no public registration. You may not share your sign-in details with anyone outside your business, and you are responsible for what is ordered using your account.

Placing orders

• An order is a request. It becomes binding when we accept it, and we may decline or adjust an order — for example if an item is unavailable.
• Prices shown are those agreed for your account and may change. The price on your invoice is the price that applies.
• Cut-off times and delivery days shown in the system apply. Orders placed after the cut-off move to the next available delivery day.
• To change or cancel an order after placing it, contact us directly on 919-463-0005. Once production has begun a cancellation may not be possible.

Invoices and payment

An invoice is raised for each order. Payment terms are as agreed with your account, normally 15 days from delivery. Where card payment is offered it is handled by Stripe; we do not receive or store your card details. Amounts shown in the system are for convenience — your invoice governs what is owed.

Availability

We aim to keep the system available but do not guarantee uninterrupted access. It may be unavailable for maintenance, or because of a fault at one of our service providers. If you cannot place an order here, telephone us on 919-463-0005 — we will take it by phone. No order is lost because the system is down.

Accuracy

We take care to keep prices, products and availability correct, but errors happen. Where an obvious error appears — for example a clearly wrong price — we may correct it and will tell you before proceeding.

Acceptable use

Do not attempt to access another customer's account or information, interfere with the system's operation, or use automated tools to extract data from it.

Our liability

The system is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss arising from its use. Nothing in these terms limits our responsibility for the goods we supply, or any liability that cannot lawfully be limited.

Suspending access

We may suspend or withdraw access to the system, for example where an account is closed or these terms are breached. This does not affect obligations already incurred by either of us.

Changes

We may update these terms. The current version is always the one on this page, and the date above shows when it last changed.

Governing law

These terms are governed by the laws of the State of North Carolina, United States.
